Introduction

This site is owned and operated by Dynamic Distribution Group Ltd, registered office: Strawberry Fields Digital Hub, Euxton Lane, Chorley, PR7 1PS, United Kingdom. Dynamic Distribution Group Ltd is the official distributor of BOGS® Footwear in the UK and EU. These terms and conditions apply to all transactions between Dynamic Distribution Group Ltd and individual consumers purchasing goods via the following websites:
www.bogsfootwear-uk.com and www.bogsfootwear-eu.com.
If you have any questions about these terms, please contact us at hello@bogsfootwear-uk.com (UK) or hello@bogsfootwear-eu.com (EU).

Ownership of Rights

All rights, including copyright, in this website are owned by or licensed to Dynamic Distribution Group Ltd. Any use of this website or its contents, other than for personal, non-commercial use, is prohibited without written permission. You may not copy, modify, distribute, or re-post anything from this website for any commercial purpose. Access to this site is provided temporarily, and we may suspend or withdraw it at any time without notice.

Acceptance of Orders

Your order is an offer to purchase. You’ll receive an acknowledgement email after placing your order, but it’s not an acceptance. Your order for goods is accepted and a contract formed when we dispatch the goods you have order and not before. A contract is not formed at the point in time when payment has been taken by us, nor at the point you receive an acknowledgement email from us. If a product was incorrectly priced, we will either contact you before dispatch or cancel your order and inform you.

We require an email address to confirm receipt of your order.

Accuracy of Content

We’ve taken every care to ensure the content on this website is accurate, especially pricing and product descriptions. Orders are only accepted if there are no material errors in the listed information. Colours shown on the website may vary depending on your screen settings, and we cannot guarantee they reflect the actual product.

Our Liability

We warrant that the goods supplied will be of satisfactory quality and fit for purpose. Our liability is limited to the purchase price and foreseeable losses arising from our breach of these terms. We are not liable for indirect or consequential losses (such as loss of profits or contracts), or for inaccuracies in the information provided on this site. The site and its contents are provided “as is,” without warranties of any kind. We are not reasonable for losses caused by a delaying event outside our control if we have done what we can to minimise the delay.

Exclusions of Liability

Nothing in these terms excludes liability for death or personal injury caused by our negligence, or for fraud. If any part of these disclaimers is found to be unlawful, the rest remains enforceable.

Availability and Withdrawal of Products

All items are subject to availability. We make every effort to ensure that stock levels are accurate at the time you place your order.

If a product you order becomes unavailable after purchase, we will contact you as soon as possible to let you know and refund any sums you have paid.

We may withdraw or discontinue products from sale at any time without notice, but this will not affect orders that we have already accepted.

We can stop selling a product at any time.

Shipping

This website ships to UK and EU addresses only. EU orders are fulfilled and invoiced from our EU warehouse and include local VAT where applicable.

Orders are typically dispatched within 1–2 working days using a tracked service. While we aim to meet our stated delivery times, delays may occasionally occur. We accept no liability for delivery delays.
Carriers will usually attempt delivery up to three times. If unsuccessful, the parcel will be returned to us, and you will be refunded minus any delivery costs. For any special delivery requirements, please contact us before placing your order.

Payment

We use Shopify Payments to process orders made through our website. Shopify Payments is a secure payment gateway provided by Shopify Inc. and powered by Stripe. When you place an order, your payment information (such as card details) is entered securely and processed directly by Shopify and Stripe.

Your full payment details are not visible to us, and we do not collect or store your card or banking information. Shopify and Stripe use advanced encryption and security protocols to keep your data safe, and handle all payments in line with the UK GDPR and EU GDPR.

For more information, you can read their privacy policies here:
- Shopify:
https://www.shopify.com/legal/privacy

-Stripe: https://stripe.com/privacy

If you choose an alternative payment option such as PayPal, Apple Pay, or Google Pay, your payment will be processed directly by that provider under their own privacy policy.

Taxes

All orders are subject to UK VAT and EU VAT where applicable. Where applicable, tax and duty will also be charged for orders delivered to Switzerland. If the rate of VAT increases between your order date and the date we supply the product to you, we adjust the rate of VAT that you pay, unless you have already paid in full.

Cancellation Right

If you want to cancel your order, please email us as soon as possible. If the order hasn’t been dispatched, we’ll issue a full refund. If it has, you can still return the item under our RETURNS POLICY.

Returns Policy

Goods purchased directly from www.bogsfootwear-uk.com or www.bogsfootwear-eu.com can only be returned in accordance with the instructions on our Returns Policy pages. Please do not return shoes purchased from other retailers.

For full details on how to return your order, please visit our Returns Policy page at www.bogsfootwear-uk.com/pages/returns.

Faulty Goods

If you believe an item is faulty, please email hello@bogsfootwear-uk.com or hello@bogsfootwear-eu.com with a description of the issue and clear photos, including the outsole. We may ask you to return the product for inspection. If the item is found to be faulty, we will provide a prepaid return label or refund your reasonable postage costs. Where possible, please return the item in its original packaging and in a clean, dry condition so that we can safely assess the fault. Faults caused by misuse, accidental damage, or general wear and tear are not covered. Items worn for 4–6 months or more (depending on usage) may be considered naturally worn under industry standards. This does not affect your statutory rights under the Consumer Rights Act 2015 (UK) or equivalent EU legislation.

These Terms apply to individual consumers only. If you are purchasing on behalf of a business, please contact us for our B2B trading terms.

Other Terms and Conditions

Additional terms may apply to specific parts of the site (e.g. returns, privacy policy, competitions). These are incorporated by reference and form part of your contract with us. You are responsible for reading and accepting them where required.

This contract is between us and you. Nobody else can enforce it.

If a court or other authority decided that some of these terms are unlawful, the rest will continue to apply.

Changes to Terms and Conditions

We reserve the right to update these terms and conditions at any time. Please check back regularly.

Disputes with Us

We will do our best to resolve any problems you have with our products. Please contact us at hello@bogsfootwear-uk.com (UK) or hello@bogsfootwear-eu.com (EU).

Law, Jurisdiction and Language

These terms are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the English courts. Contracts are concluded in English. These terms do not affect your statutory rights.

If you are based in the EU, you may also benefit from certain mandatory consumer protection laws of your country of residence.
